We at Child Rights Initiative (CRI), sincerely and respectfully record our honest appreciation of your judgment regarding the shared parenting & custody in the matter of Minro Vijay Sri Hari in A. No. 248/2011 in O.P. No. 12/2011. We are overwhelmed by your grace shown on children in distress.

Your humane approach unfolds before us, the court of Krishnadevraya. You have excelled Krishnadevara by ordering the child to a more permissive environment, than being ‘cut into two’. Today we wish that all unfortunate children in the crossfire of matrimonial disputes are showered with similar concerns by all Guardian courts all over the country.

We are particularly overwhelmed by your thoughtful and far reaching observations that will go a long way:

1. Para 29 reads as, “ A person who is a bad child to his/her parents, a bad partner to his/her spouse or a bad Samaritan to his/her neighbours, could still be a good parent. Similarly a person who is too good to his/her parents, his/her spouse and his/her neighbours, may prove to be a bad parent”. This ultimately recognizes the right of the child to access both biological parents despite if the mother happens to be prostitute or father happens to be a drunkard or murderer. We could see someone who can really understand the need of the child from its shoes rather than social stereotyping.
2. Para 30 reads as, “ then it is their duty, under normal circumstances, to draw up parenting schedule and share the responsibility of co-parenting to bring up the child in a happy and healthy environment.” This concept of shred parenting, we pray, becomes norm in the custody related matters through out the country.
3. Para 31 reads as, “It is quite unfortunate that the courts still dabble with the age old concepts of custody and visitation rights. These terms emanate from a rights regime rather than a responsibilities regime. We sincerely thank you for the emphasis on paradigm shift from Rights to Responsibilities.

We feel that the Indian Judiciary is the Cavour of children in distress, particularly when our law makers are insensitive to their needs.

We are also requesting Chief Justices of all High Courts in India seeking their direction to all family courts under their jurisdiction to implement the gist and sprit of your message on child rights to have equal access to both biological parents.

Many of the Children in distress all over India are indebted to you personally.

May the almighty bless you with bountiful of health and long life.
